MUMBAI : A vacation bench comprising of Justice Shahrukh Kathawala and Justice Ajay Gadkari of the Bombay High Court on Friday will give its hearing on 4 June to the petition by the Kashimira Hotel Association (KHA).The KHA wanted the cancellation of dry days in Kashimira bars due to the ensueing Palghar Lok Sabha bypoll on 28 May said Vishal Thadani counsel for the KHA.
Santosh Puthran president KHA had filed the petition before the HC seeking cancellation of dry days in Kashimira for the Palghar bypoll. The HC on Friday will hear the case on 4 June.
The government has declared dry days in some parts of Kashimira and Mira Road which fall within 5 kms radius along the borderline of Palghar LS constituency i.e. Vasai Assembly segment. The Excise department had sent notices to 58 liquor selling establishments including 38 beer bars,13 beer and wine shops and 2 country bars in Kashimira to shut from 1800 hrs on 26 May till 28 May which is the polling day and again on 31 May the closure will be maintained which is the counting day.
Said Puthran, the Kashimira district does not come in Palghar LS constituency and the ban is unjustified and losses for the liquor bar owners as majority of the employees are on daily wage basis. Hence we had petitioned before the HC he said.
An Excise officer said the closure notices for dry days were sent to the 58 liquor selling units under the State Foreign Liquor (sale on cash register of sales) Rules 1969, State Country Liquor Rules 1973,State Toddy Trees(tapping) Rules 1978.
It is to be known during any elections transportation and storage of liquor is banned for a free,fair and peaceful election as per the EC rules.
